Bolivar council puts sand, gravel mining on hold in Ohio

The Bolivar Village Council in Bolivar, Ohio, voted almost unanimously Tuesday night against Massillon Materials’ request to rezone 182 acres of agricultural land to industrial manufacturing, according to the Times Reporter [2].

The decision slows Massillon Materials’ plans to begin a sand and gravel mining operation in the town.

All but one member of the council voted against the rezone request.

Massillon Materials, which provides asphalt for parent company Northstar Asphalt, purchased 65 acres from Bolivar for $1.1 million last year. The company then petitioned for 182 acres next to the property to be annexed from Lawrence Township into Bolivar. Tuscarawas County Commissioners granted the expedited request in March.

Brian Barger, the attorney representing Howard Wenger, owner of Massillon Materials, said the property would be used for sand and gravel mining but not as an asphalt plant, and that the Ohio Department of Natural Resources and the Ohio Environmental Protection Agency would regulate the facility.

Barger said the operation would be a wet-mining operation. No water would run into the Tuscarawas River or any tributaries, he added.

Nearby residents have raised concerns about the operation, such as noise, dust, water pollution and truck traffic.

Barger said Wenger has no problem with waiting for three meetings, public comment and the 30-day period to pass the ordinance.

If it is passed, Bolivar’s board of zoning appeals will next vote on a conditional-use clause.
