Commissioners decline residents’ request for stricter permit limits on Kansas quarry

The Douglas County Commission in Kansas last week declined residents’ request for stricter limits on the Hamm-Buchheim Quarry’s conditional use permit, the Lawrence Journal-World reported [2].

According to a previous report from the Lawrence Journal-World [3], residents who live near the quarry complained that it had been idle for most of the previous 35 years until blasting operations began in October 2012, adding that they received no advance notice that blasting would resume.

The commission said it didn’t have the authority to change the terms of the permit.

Other residential concerns included excessive noise, truck traffic and excessive dust from trucks travelling on a nearby gravel road.

Commissioners and quarry operator N.R. Hamm Inc. agreed to share the cost of suppressing dust on the gravel road. Additionally, the commission approved a 40 mph speed limit on the gravel road.

Commissioner Jim Flory said the commission would consult with County Counselor Evan Ice about whether the terms of the permit can be changed.
