The Lower Milford township board of supervisors has decided to go to the Pennsylvania Supreme Court after State Commonwealth Court judges last month overturned the township planning commission’s unanimous rejection of Geryville Materials Inc.’s quarry proposal, according to a report from The Morning Call .
The township has spent more than $1 million in legal costs related to the nearly decade-long quarry case.
Lehigh Valley Live reported that Geryville wants to build a 84.56-acre stone quarry on West Mill Hill Road, but the township planning commission rejected the request two years ago.
According to The Morning Call’s report, the planning commission said it rejected the plan because the developer only addressed 85 of the 628 acres in its plan, and because the plan failed to comply with natural resources provisions in the township’s zoning ordinance.
In addition to township officials, the Lower Milford Residents Association has been fighting the quarry for several years, pointing to noise, blasting, stone crushers and truck traffic as threats to air and water quality.
According to a report from The Upper Saucon Patch , the state Supreme Court will likely take some time to choose whether to hear the township’s appeal.
