This webinar will address the new FMSHRC ruling governing MSHA requests for non-mandatory documents related to injuries/illnesses, the Mine Safety and Health Administration’s (MSHA) use of injunctions to obtain other information such as audit reports, near miss information, and safety procedures through Section 108(a)(1)(E) of the Mine Act, and the Occupational Safety and Health Administration’s (OSHA) use of subpoenas to compel production of documents and testimony from both employers and third parties (such as insurance companies) before citations are ever issued. The principles of how to privilege key reports and information will be addressed, as well as how to manage document requests that arise during routine inspections, special investigations, accident cases and Section 105(c) “whistleblower” investigations.
