Pennsylvania Supreme Court denies Lower Milford township’s request to present case

March 28, 2014

The Pennsylvania Supreme Court has decided to not hear a decade-long case regarding the Lower Milford township planning commission’s unanimous rejection of Geryville Materials Inc.’s quarry proposal, The Morning Call reports.

Geryville Materials wants to operate an approximately 85-acre quarry on a 628-acre property in the township.

The township decided in August to take the case to the state’s supreme court after state Commonwealth Court judges in July overturned the planning commission’s rejection of the quarry proposal.

Now Geryville Materials is awaiting the township’s Zoning Hearing Board’s decision on the proposal.

Additionally, both Geryville Materials and the Lower Milford township are waiting to hear a Commonwealth Court decision on a zoning change previously sought by Geryville Materials.
